Job Description

Job Purpose: The Staff Attorney position at the Public School Facilities Authority (PSFA) advises on a variety of legal matters, including procurement issues, contract drafting, contract review, contract negotiations, and contract disputes related to construction projects. This role involves preparing for and representing the agency at mediations and arbitrations. Additionally, the Staff Attorney provides legal advice on matters related to the Inspection of Public Records Act (IPRA), the Open Meetings Act (OMA), employment-related issues, and conducts bill analysis during the legislative session. The position also reviews leases submitted by charter schools and school districts for the lease assistance program offered by the Public School Capital Outlay Act. Furthermore, the Staff Attorney assists in the development of policies and procedures and provides legal assistance on other matters as needed.

Duties and Responsibilities:

• Legal Advice

o Sound Legal Advice: Provide the agency with sound legal advice in accordance with pertinent laws and regulations to either avoid or minimize risk.

o IPRA and OMA: Provide legal advice on matters related to the Inspection of Public Records Act (IPRA) and the Open Meetings Act (OMA).

o Employment Law: Assist management with general employment law concerns, contracts, claims, and creating employment policies.

o Other Legal Matters: Provide assistance on other legal matters as assigned and needed by the agency.

• Contract Management

o Contract Drafting and Review: Advise on procurement issues, contract drafting, contract review, contract negotiations, and contract disputes.

o Lease Review: Conduct review of leases submitted by charter schools and school districts for the lease assistance program offered by the Public School Capital Outlay Act.

• Representation

o Mediations and Arbitrations: Prepare for and represent the agency at mediations and arbitrations related to disputes resulting from construction projects in which the agency is a co-owner.

• Legislative Analysis

o Bill Analysis: Conduct bill analysis during the legislative session.

• Policy Development

o Policy and Procedure Development: Provide legal assistance and guidance related to the development of policies and procedures of the agency.

• Presentations

o Professional Presentations: Prepare and deliver professional presentations as needed.

Knowledge, Skills, and Abilities Required:

• Knowledge

o Confidentiality: High level of confidentiality required.

o New Mexico Administrative Code (NMAC): Comprehensive understanding of NMAC applicable to various complex contract types.

o State and Federal Laws: Expertise in state and federal laws regarding contract terms and employment law, including Federal Acquisition Regulations (FAR).

o Government Purchasing and Contract Administration: Knowledge of legal requirements and principles of government purchasing, budgeting, accounting, finance, and contract administration.

o Project Management: Knowledge of project management principles, practices, techniques, and tools.

o Construction Practices: Knowledge of the operating practices of construction, architectural, and building.

o Construction Contract Documents: Knowledge of construction contract documents, specifications, and related professional services.

o Documentation: Ability to document clear, concise, and technically accurate memoranda, letters, decisions, and meeting minutes.

o Fact-Finding and Analysis: Knowledge of methods and techniques for fact-finding, analysis, and resolution of complex problems.

Minimum Education and Experience:

• Juris Doctorate and active membership in the New Mexico State Bar Association.

• Five to seven years of experience directly related to government or construction contracts or the specified duties and responsibilities.

• Experience or education may be substituted for one another at the discretion of the Executive Director.

Working Conditions:

• Operates in a professional office environment with standard office equipment.

• Occasional evening and weekend work may be required.

• Travel is primarily local during the business day, with some out-of-area and overnight travel expected.

Physical Effort:

• Minimal physical activity required; extended periods of sitting.

• Regularly required to speak and/or listen.

Supplemental Information:

• Must possess and maintain a valid New Mexico driver's license.
